For over 80 years, the hemp plant has been banned and associated with its THC-rich cousin. Although they are both members of the Cannabaceae family, cannabis and marijuana have traditionally been used for many different things. Industrial hemp is non-toxic, has a long history with humans, and has been used for thousands of years to make textiles, paper, food, etc. Cannabis also has a long relationship with humans and is used for less applied purposes, such as medicine, rituals and pleasure.
It wasn’t until 2018 that cannabis and marijuana were legally separated in the US with the passage of the 2018 Farm Bill, which finally defined cannabis as distinct from marijuana and allowed its cultivation and distribution.
Judging by the size of the U.S. cannabidiol (CBD) market and the rapid growth of cannabis concentrates, consumers are expressing a desire to try the industry’s new offerings. Now that cannabis is legal, so is smoking CBD or hemp buds – also known as cannabis flowers or CBD flowers.
What is the difference between CBD and cannabis? Do hemp buds contain CBD?
If you want to get high, you won’t find it with a hemp flower. Hemp plants are produced for industrial purposes and contain very little intoxicating THC. And if you need medical grade CBD, cannabis buds are generally not rich in CBD and are not a very effective way to obtain a cannabinoid.
However, CBD derived from high-THC cannabis is much more likely to have higher levels of CBD and terpenes, the aromatic compounds responsible for the distinct aroma and flavor of cannabis. CBD based on cannabis has much greater medicinal benefits than CBD based on cannabis and shouldn’t get you high, as long as it stays under the federal legal limit of 0.3% THC.
One of the goals of the Farm Bill was to distinguish non-intoxicating industrial hemp from marijuana containing THC, and to isolate 0.3% THC in the separation process. Anything above that threshold is considered marijuana and is still illegal at the federal level.

Growing demand for hemp and CBD products
Smokable cannabis buds have been somewhat controversial among states and law enforcement because they smell and look like THC-based products, and law enforcement currently does not have the technology to determine if a product is legal without sending it to a lab for testing.
But this has not stopped the booming market for cannabis consumption. According to Nielsen market research, the smoked cannabis market – including categories such as CBD flower, CBD pre-rolls and other inhalants – will reach $70 million to $80 million in sales by 2020. Separately, smoked hemp flower and CBD pre-rolls are valued at $35-40 million. The Nielsen report predicts a dramatic increase in the smoking cannabis market to $300-400 million by 2025.
CBD is a consistent consumer trend due to its anti-inflammatory and soothing properties, which have found their way into products such as intimate lubricants, tinctures, shampoos, and most recently, CBD-smoked hemp buds. And this market rise shows no sign of abating. Research firm Cannabis Research says the global CBD market was worth $4.6 billion in 2018 and is expected to reach $9.69 billion by 2025.

However, this growth does not reflect how the CBD industry is managing to succeed in the current patchwork of legalization. For example, in New York it is legal to possess CBD as long as it is not smoked, while in Idaho CBD in any form is completely illegal. Several states have already taken steps to severely restrict or even ban cannabis smoking, including Texas, Kentucky, Louisiana, Indiana and Iowa.
Federally legal cannabis does not automatically confer legitimacy on the state. In fact, the Farm Bill leaves it up to the states to decide whether CBD is legal within their borders, leading to confusion for consumers and farmers alike.
The Farm Bill itself has not legalized CBD, leaving a vacuum in oversight that gives consumers little guidance on which CBD cannabis buds – or CBD at all – are safe to consume. There is currently no federal oversight of the packaging, labeling, and sale of cannabis buds, so individual cannabis businesses must follow their own state’s guidelines.
It is also clear that the policy is way behind the market and consumer demand, although some steps have been taken. The CBD Consumer Protection and Market Stabilization Act has been introduced in Congress. If passed, this law would allow hemp and CBD cannabis to be sold and distributed as dietary supplements, but would not apply to smoking CBD and cannabis.

Hemp buds are increasingly easy to find and can often be found in smoke shops and CBD stores, even in states where cannabis is not legal. Yet it is a market of dreaded buyers. As with CBD, it is important to know what you are buying. Since there are no government regulations in this market segment, companies are not required to produce a product suitable for consumption or to test it for toxins and contaminants. Buy only from licensed dispensaries, where you can speak with a customer service representative, view cannabinoid profiles, and easily find lab results.
